LEGAL REGULATION OF PROFESSIONAL SELF-REALIZATION OF WAR VETERANS IN THE CONTEXT OF THE IMPLEMENTATION OF LABOR AND ENTREPRENEURIAL RIGHTS

Abstract

Introduction. In contemporary conditions, the professional self-realization of war veterans acquires a complex significance as both a socio-economic and legal phenomenon, associated with the realization of the right to work, the freedom of entrepreneurial activity, the right to education, and the principle of non-discrimination. Despite the existence of an extensive regulatory framework, the legal regulation of this sphere remains fragmented, which complicates the formation of a coherent mechanism for the effective implementation of veterans’ rights.

Purpose. The purpose of this article is to develop an author’s approach to understanding the professional self-realization of war veterans as a complex object of legal regulation integrated with entrepreneurial rights, as well as to substantiate proposals for improving the current model of legal support in this field in Ukraine.

Materials and Methods. The methodological basis of the study includes general scientific and special legal methods, in particular: the systemic-structural method (to analyze professional self-realization as a complex legal construct and identify interconnections between its elements), the formal legal method (to interpret the norms of current legislation and determine their content in the field of legal regulation of veterans’ professional self-realization), the comparative legal method (to compare domestic and foreign approaches to legal regulation and scientific concepts of veteran entrepreneurship), and the method of legal modeling (to formulate the author’s definition of professional self-realization of war veterans and develop proposals for improving legal regulation).

Results. The article substantiates that the professional self-realization of war veterans has an interdisciplinary character and encompasses not only traditional employment but also self-employment and entrepreneurial activity as equal forms of economic engagement. An authorial definition of professional self-realization is proposed as a legally mediated process of implementing an individual’s labor and entrepreneurial potential. It is established that the current legal regulation, despite the existence of specialized legislation and support programs for veteran business, remains predominantly universal in nature and does not adequately take into account the diversity of needs among different groups of veterans. A regulatory gap has been identified, consisting in the absence of the principle of a differentiated (individualized) approach to supporting veteran entrepreneurship.

Prospects. Promising directions for further research include the development of a theoretical and legal framework for the individualization of mechanisms of professional self-realization of veterans, the improvement of the legal design of state support programs, and the integration of relevant regulation with the processes of economic digitalization, the development of flexible forms of employment, and new models of entrepreneurial activity.
