Abstract

Introduction. The development of a democratic state governed by the rule of law requires transparency in the activities of public authorities and effective instruments for public influence on decision-making. Public oversight serves as a key mechanism for enhancing accountability and openness in public administration, which is particularly significant in the work of Ministry of Justice of Ukraine. Despite the availability of various forms of civic participation—public councils, consultations, working groups, and mechanisms for access to public information—their actual effectiveness remains limited due to insufficient data transparency, unclear procedures, and the formal nature of interaction. This necessitates a comprehensive analysis of existing mechanisms of public oversight and the identification of ways to improve them.

Purpose. The purpose of this study is to analyze the current state of institutional mechanisms of public oversight over the activities of the Ministry of Justice of Ukraine and to determine directions for their further enhancement in accordance with the standards of democratic governance and the practices of the European Union.

Materials and Methods. The study is based on legal and regulatory acts, official reports, and open data governing public oversight within the competence of the Ministry of Justice of Ukraine. The methodological framework includes systemic and institutional approaches, document analysis, comparative legal analysis, and structural-functional analysis. Additional methods include the generalization of civic participation practices and the assessment of the effectiveness of existing oversight mechanisms.

Results. The article examines the content and contemporary approaches to understanding the concept of “public oversight” in the field of public administration, as well as its specific application to the activities of the Ministry of Justice of Ukraine. Drawing on the works of Ukrainian and international scholars, the study identifies key models of public oversight and their impact on the accountability and transparency of public authorities. Particular attention is paid to assessing the effectiveness of civic participation tools within the Ministry of Justice of Ukraine, including the work of public councils, public consultations, digital participation instruments, and independent monitoring mechanisms.

The study also analyzes international openness standards, including the norms of United Nations, Council of Europe, the Organisation for Economic Co-operation and Development (OECD), and the principles of the Open Government Partnership, which emphasize access to information, stakeholder engagement, and institutional openness. Based on the analysis, the study proposes directions for improving public oversight mechanisms over the Ministry of Justice of Ukraine aimed at enhancing transparency, digitalization of procedures, expanding monitoring opportunities, and strengthening public trust in the justice system.

Discussion. The further development of institutional mechanisms of public oversight over the activities of the Ministry of Justice of Ukraine requires improving the regulatory framework, expanding opportunities for public participation in decision-making, digitalizing interaction procedures, and increasing the transparency of administrative processes. Promising directions include strengthening monitoring tools, developing standards for evaluating oversight effectiveness, and expanding partnerships between public institutions and civil society organizations.
