INSTITUTIONAL AND LEGAL FOUNDATIONS OF STATE CONTROL OVER COMPLIANCE WITH LABOR LEGISLATION IN UKRAINE: NATIONAL AND INTERNATIONAL DIMENSIONS

Abstract

Introduction. Ensuring effective state control over compliance with labour legislation has become particularly relevant in the context of public administration reform and European integration processes in Ukraine. Strengthening guarantees of labour rights requires improvement of the institutional and legal mechanisms of labour inspection activities. Purpose. The purpose of the article is to conduct a comprehensive analysis of the institutional and legal foundations of state supervision in the field of labour, taking into account international ILO standards, and to determine directions for improving the national control system. Materials and Methods. The research is based on the analysis of the provisions of the Labour Code of Ukraine, the Law of Ukraine “On the Basic Principles of State Supervision (Control) in the Sphere of Economic Activity”, subordinate acts of the Cabinet of Ministers of Ukraine, the Regulation on the State Labour Service of Ukraine, as well as ILO Conventions and Recommendations No. 81 and No. 129. The study applies formal-legal, comparative-legal, and systemic-structural methods. Results. The role of labour inspection as a key element in the mechanism for ensuring labour rights has been determined. The study reveals the fragmented nature of the regulatory framework and the need for a clear delineation of powers between the State Labour Service and local self-government bodies. The expediency of transitioning to a preventive and risk-based inspection model using digital tools is substantiated. Prospects. Further research should focus on the codification of labour control legislation, harmonization with EU law, and strengthening the institutional capacity of state supervisory authorities.
