THE LEGAL ADJUSTING OF PROVIDING OF ECOLOGICAL SAFETY IN THE FIELD OF LAND USE OF UKRAINE IN THE CONDITIONS OF MARTIAL LAW

Abstract

Introduction. The conceptual and doctrine principles of the legal adjusting of providing of ecological safety are investigational in the sphere of the land use of Ukraine. That the legal adjusting of providing of ecological safety in the field of land-tenure of Ukraine in the conditions of martial law tested the substantial changes, predefined by the necessity of combination of guard of environment and landed resources, ecological safety and harmonization of the legal adjusting with the instruments of the European right are certainly. The modern legislation adapts oneself to the new calls, providing balance between the guards of earth, as basic national riches, by the necessities of defensive of the state, prevention of ecocatastrophes are currently important. The norms of right for ecological safety acquire maintenance in the process of their realization that is real and effective regulative and to protective effects on existent and potential public nature protection and ecological legal relationships in the field of providing of ecological safety in the field of land-tenure is analysed.

Purpose. The research aim is an analysis of conceptual and doctrine positions of ecological safety in the field of land use of Ukraine, taking into account position of the European and national right in the sphere of it. An analysis of legal nature of this phenomenon is on the basis of the legal and regulatory framework adjusting of mechanisms of providing of ecological safety.

Materials and methods. The research materials are international legal and regulatory framework, and other, instruments of the European right and Ukraine, and also their doctrine analysis in the context of legal causation of providing of ecological safety in the field of land use is specified. The methods include the analysis of the systems of legal norms, comparative analysis of precedents what a national legislation is built on, also content-analysis of doctrine sources; wish enables identification of the leading doctrine approaches that exist in relation to the subjects of ecological safety in the field of land-tenure in the system of legislation of Ukraine.

Results. The legal literature of concept «earth» is traditionally examined as a complex object of the legal adjusting, in relation to that arise up, realized and property rights, public and ecological legal relationships, are guarded is specified. It grounds to ground, that the legal adjusting of providing of ecological safety in the field of land-tenure needs the theoretical fitting for terminology system; wish regulates a recreation and guard of environment and landed resources. A legal safeguard in the sphere of it comes true at application of all legal norms wish is related to the guard and use of earth resources.

Further research in this area. The prospects of further scientific developments updating of legal and regulatory framework of providing of ecological safety related to research in the field of land-tenure of Ukraine. Mechanisms for ensuring environmental safety in this field should be implemented in accordance with the latest legislation, based on a differentiated approach distinguishing between economic and regulatory areas, aligned with advanced European standards of land use.
