THE LEGAL ADJUSTING OF PROVIDING OF ECOLOGICAL SAFETY IS IN THE SPHERE OF WATER SECTOR OF UKRAINE IN THE CONDITIONS OF MARTIAL LAW

Abstract

Introduction. The conceptual and doctrine principles of the legal adjusting of providing of ecological safety are investigational in the sphere of the water sector of Ukraine. That the legal adjusting of ecological safety in the water sector of Ukraine in the conditions of martial law tested substantial transformations for the sake of providing of ecological stability, economic development and social prosperity is certainly. The modern legislation adapts oneself to the new calls, balancing between proceeding in water resources that are the inalienable constituent of natural riches of Ukraine necessities of defensive, minimization of harm to the environment and for the sake of prevention of ecocatastrophes are currently important. The norms of right for ecological safety acquire maintenance in the process of their realization, real and effective regulative and to protective influence on existent and potential public nature protection and ecological legal relationships in the sphere of providing of ecological safety of water sector of Ukraine are analysed. The deficiencies in law enforcement, gaps in legislation, and blanks of law enforcement, insufficient presence of socioeconomic terms of introduction of effective measures of providing of ecological safety, result in a volume, that a right for ecological safety becomes declarative. The mechanisms of providing of ecological stability are considered – safety of natural environment, that at an international level the international agreements sanctified to the questions of ecological safety of natural environment play an important role, including guard of water resources and counteraction to contamination and inefficient use bodies of water.

Purpose. The research aim is an analysis of conceptual and doctrine positions of ecological safety of water sector of Ukraine, taking into account position of international law in the field of it. An analysis of legal nature of this phenomenon is on the basis of the normatively-legal adjusting of mechanisms of providing.

Materials and methods. The research materials are international legal acts, and other, acts of the UNO and Ukraine, and also their doctrine analysis in the context of cause-and-effect relationship of ecological safety of water resources. The methods include the analysis of the systems of legal norms, the comparative analysis of precedents on what a national legislation is built on, also content-analysis of doctrine sources, that allows reducing leading doctrine approaches that exist in relation to the subjects of ecological safety of water sector in the system of legislation of Ukraine.

Results. The legal norms that touch the guard of water objects in the conditions of martial law fix the limits of active behaviour of parties of legal relationships in relation to providing of aims of guard of water resources, the right and duties subjects of bank protection legal relationships set, bring in coordination, good organization and order in the system of guard of water objects and use of water resources it is specified. A legal safeguard in the field of it comes true at application of all legal norms that is related to the guard and use of water resources.

Further research in this area. The prospects of further developments are related to research of normatively-legal base in relation to ecological safety in relation to a water sector. By introduction, in accordance with the newest legislation, in relation to water industry, differentiated dividing into managing and supervisory directions, according to the front rank international standards of conduct of water sector. The special attention is needed by research of functioning and intercommunication of central government and regional agencies that inculcate a public policy and control activity of subjects of legal relationships in the field if water economy in the conditions of military bodies.
