ADMINISTRATIVE AND LEGAL PRINCIPLES OF SIMPLIFICATION OF PERMITTING AND REGISTRATION PROCEDURES IN URBAN PLANNING ACTIVITIES IN THE CONDITIONS OF MARTIAL STATE IN UKRAINE: RISKS AND PROSPECTS

Abstract

Introduction. This study provides a comprehensive analysis of the regulatory and legal transformation within Ukraine’s architectural and construction sector under the conditions of martial law. The relevance of the research stems from the imperative to critically re-evaluate the mechanisms for restoring destroyed infrastructure and resolving the acute housing crisis, which has impacted internally displaced persons. Purpose. The primary objective of the work is to evaluate the effectiveness of simplified construction procedures and to identify systemic risks arising from rapid market liberalization during the conflict. Materials and methods. The informational basis of the study includes the current legislative acts of Ukraine, strategic risk reports from the National Agency on Corruption Prevention, and official clarifications from the State Inspectorate for Architecture and Urban Development. The research methodology is based on a system analysis approach, the formal-legal method, and a comparative analysis of legal regimes in peacetime versus wartime. Results. Particular attention is paid to the analysis of Resolution No. 722, which introduced the principle of "tacit consent" for obtaining urban planning conditions and restrictions, the possibility of designing individual residential buildings without a construction passport, and the full digitalization of permitting processes through the Unified State Electronic System in the Field of Construction. The study also examines Law No. 3563-IX, which simplified the change of land use for industrial and energy facilities, and Law No. 2518-IX, designed to protect the rights of investors in future real estate through the mandatory registration of special property rights and the establishment of a "guarantee share". The research highlights potential negative consequences resulting from the moratorium on State Architectural and Construction Control, which, combined with excessive discretionary powers of officials, creates opportunities for corruption and the violation of technical standards. A special emphasis is placed on the inadmissibility of neglecting accessibility (barrier-free) and energy efficiency norms under the guise of "wartime simplifications." According to the State Inspectorate for Architecture and Urban Development, while decorative finishing can be postponed, elements for people with disabilities and thermal insulation must be implemented immediately, adhering to the "Build Back Better" concept. Discussion. The scientific novelty of the study lies in the systematization of wartime legal innovations as a transitional regulatory model based on the delegation of responsibility to certified professionals. The conclusions emphasize that sustainable development of the sector is possible only through the full integration of the DREAM ecosystem and the adaptation of domestic standards to EU Regulation 2024/3110. The results hold practical value for developing comprehensive community recovery programs and improving anti-corruption policies in the construction industry.
