CURRENT ISSUES IN STATE SUPERVISION (CONTROL) IN THE FIELD OF SUBSOIL USE

Abstract

Introduction. State supervision (control) in the field of subsoil use is critical to preventing the depletion of resources and protecting the economic, environmental, and security interests of the state and society. It ensures the rational extraction of minerals, compliance with environmental standards, and safeguards the economic interests of the state. At the same time, the duplication of functions and the fragmentation of authority in the field of subsoil use are among the main challenges facing the state management of subsoil resources in Ukraine.

Purpose. The purpose of this study is to examine current issues in the legal regulation of supervisory and control relationships arising in the field of subsoil use.

Materials and methods. The research materials include: 1) Ukrainian laws and regulations governing control and supervisory, economic, environmental, mining, and geological relations; 2) empirical data consisting of actual facts and the results of studies on state supervision (control) in the field of subsoil use; 3) scientific publications devoted to legal and other aspects of control and supervisory activities in the field of subsoil use. The following primary methods of scientific inquiry were employed in the course of this study: the comparative legal method (to identify differences in state control and supervision regarding the use of subsoil resources); the formal legal method (to clarify the content of legal provisions in normative acts); the systemic method - for a comprehensive study of the legal regulation of the procedure for state supervision (control); and the method of documentary analysis - in the process of studying informational and reference materials.

Results. This research article examines a number of specific and problematic issues associated with state geological oversight at its current stage of development. It has been established that currently in Ukraine, in the sphere of state supervision (control) over subsoil use, authorized entities carry out three types of such supervision. It is argued that the domestic system of state supervision (control) in the sphere of subsoil use is being modernized to meet European standards.

Prospects. Future research should focus on the prospects for the development of subsoil legislation, particularly with regard to investor guarantees, royalty payments, and measures to promote the circulation of special permits.
