THE CONCEPT AND LEGAL REGULATION OF CONDUCTING PROCEDURAL ACTIONS DURING INTERNATIONAL COOPERATION IN CRIMINAL PROCEEDINGS

Abstract

Introduction. The article provides a comprehensive scientific and legal analysis of the concept and legal regulation of conducting procedural actions within the framework of international cooperation in criminal proceedings. Theoretical approaches to defining the content of international interaction between law enforcement agencies in the field of criminal justice are examined, and its significance for effective counteraction to transnational crime is determined. It is substantiated that in the context of globalization of social relations and the active development of international relations, the number of criminal offenses of an international or cross-border nature is increasing, which necessitates the establishment of an effective mechanism of cooperation between competent authorities of different states.

The purpose of the study is to analyze the concept and specific features of the legal regulation of conducting procedural actions within international cooperation in criminal proceedings.

Materials and Methods. The research materials include: 1) the regulatory and legal framework governing the conduct of procedural actions within international cooperation in criminal proceedings; 2) works of domestic scholars conducting scientific and practical research in the field of criminal procedural law, particularly regarding international cooperation in criminal proceedings.

Results. The article reveals the essence of procedural actions carried out within the framework of international cooperation and determines their place within the system of criminal procedural law. The main forms of international legal assistance are analyzed, in particular the execution of procedural requests, conducting investigative (search) actions, service of procedural documents, questioning of persons, conducting expert examinations, searches, and other procedural measures aimed at obtaining evidentiary information in criminal proceedings.

Special attention is paid to the study of the regulatory framework governing the conduct of procedural actions within international cooperation. The provisions of the Criminal Procedure Code of Ukraine, international treaties, and conventions that determine the legal foundations of interaction between states in the field of criminal justice are analyzed. It has been established that the legal regulation of this activity has a multi-level character and is based on the combination of norms of national legislation and international law.

Prospects. Further scientific research should focus on the procedure for documenting procedural actions within international cooperation in criminal proceedings, as well as on the development of an appropriate methodology for their analysis. This will make it possible to improve the methodology and organization of international cooperation in criminal proceedings.
