PRINCIPLES OF REGULATORY AND INSTITUTIONAL SUPPORT FOR THE IMPLEMENTATION OF PUBLIC AUTHORITY DECENTRALIZATION IN UKRAINE

Abstract

Introduction. The issue of decentralization as a special system of public administration, in which part of the functions of state power is transferred to local self-government bodies, has always remained relevant and important in the theory of public administration and administration. In this aspect, the development of scientific and theoretical principles of the functioning of the public administration mechanism, the delimitation of the competence of state authorities and local self-government bodies, national and municipal public authorities, with priority given to the latter, is of great importance. The development of such issues is impossible without conducting a scientific study of the retrospective of the decentralization process in Ukraine, as well as the current state of the implementation of local public authority decentralization in Ukraine.

Purpose. The purpose of the study is to study the principles of regulatory and institutional support for the implementation of public authority decentralization in Ukraine, including in retrospect.

Materials and methods. The materials of the study are: 1) regulatory and legal support for the decentralization of local public authority; 2) works of scientists who studied the issue of decentralization of local public authorities, including the development of legislation in the relevant field of study, the process of adapting the legislation on local public authorities of Ukraine in the context of implementing the concept of reforming local self-government and territorial organization of power in Ukraine.

In the process of conducting the study, the following scientific methods were used: empirical method (provided an opportunity to collect the necessary data to study the issues of regulatory and institutional support for the implementation of decentralization of public authorities in Ukraine); observation (allowed us to process the works of scientists on determining the legal nature of decentralization of public authorities, the development of legislation in the relevant field of study); logical generalization of results (provided an opportunity to formulate conclusions).

Results. The scientific article reveals the main principles of regulatory and institutional support for the implementation of decentralization of public power in Ukraine, including in retrospect, it is indicated that today in Ukraine there is a positive dynamic in the matter of decentralization of power: the reform of administrative-territorial division has been completed, AHs have been formed, to which land and communal property have been transferred. Of course, under the conditions of the legal regime of martial law, there is a certain narrowing of the powers of local self-government bodies, and in some places their powers are transferred to military administrations, but after the termination of this legal regime, it is important to further improve the organizational and legal mechanism for the implementation of decentralization of public power in Ukraine. We can state that although the decentralization of public power at the level of territorial communities and districts has been completed to date, the reform faces a number of challenges, including legal uncertainty, imperfection of the regulatory framework, and a certain "rollback" of the reform caused by the conditions of repelling the Russian invasion and the need to implement martial law measures by specially created bodies of military-civilian administration - military administrations.

Discussion. n further scientific research, it is proposed to focus attention on the legal nature of financial decentralization of public power.
